TERMS OF SERVICE AND EULA

Effective Date: June 2, 2026

This End User License Agreement (“EULA” or “Terms”) is a legal agreement between you and Global Sade Gıda Pazarlama Sanayi ve Ticaret Limited Şirketi (“Company”, “we”, “us”, or “our”) for the use of the Stylecam mobile application (“App”).

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

  1. License Grant & Scope

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App on mobile devices owned or controlled by you, strictly in accordance with these Terms and the usage rules set forth by the Apple App Store and Google Play Store.

  1. Age Restrictions & Eligibility

You must be at least 13 years of age to use this App. If you are between 13 and 18 years old, you review these Terms with your parent or legal guardian to ensure they understand and agree to them. By uploading any photos to the App, you warrant that you meet these age requirements.

  1. User-Generated Content (UGC) & AI Try-On
  • Photo Uploads: The App allows you to upload photos of yourself and clothing items to generate AI simulations. You retain all ownership rights to your original photos.
  • Your Responsibility: You are solely responsible for the photos you upload. You strictly agree NOT to upload any photos that contain nudity, explicit content, violence, copyrighted material without permission, or images that infringe upon the privacy rights of any third party.
  • Abuse & Moderation: We reserve the right to immediately terminate or suspend your access to the App if you violate these content rules. Apple users acknowledge that the App enforces a zero-tolerance policy for objectionable content.
  1. Subscriptions, Credits, and Payments (RevenueCat)

Stylecam offers premium features, subscription models, and top-up credit bundles managed securely through RevenueCat and processed via Apple App Store / Google Play Store billing systems.

  • Subscription Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Credit Bundles (Top-up): Purchased credits are non-refundable and non-transferable. Credits are consumed each time the AI Try-On process is executed.
  • Refunds: All financial transactions and refund requests are handled exclusively by Apple or Google, depending on your device platform. We do not process refunds directly.
  1. Limitation of Liability & Disclaimers
  • “As Is” Basis: The App and the AI-generated results are provided on an “As Is” and “As Available” basis. We do not guarantee that the AI try-on simulations will perfectly reflect real-world clothing fit or appearance.
  • No Technical Liability: We are not liable for any server downtime, API processing delays caused by third-party AI models (Vertex AI), or data loss.
  1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey. Any disputes arising from the use of the App shall be resolved under the jurisdiction of the courts of Antalya, Turkey.

NUTZUNGSBEDINGUNGEN UND EULA

Dies ist eine rechtsverbindliche Endbenutzer-Lizenzvereinbarung („EULA“ oder „Bedingungen“) zwischen Ihnen und der Global Sade Gıda Pazarlama Sanayi ve Ticaret Limited Şirketi („Unternehmen“, „wir“, „uns“ oder „unser“) für die Nutzung der mobilen Anwendung Stylecam („App“).

Durch das Herunterladen, Installieren oder Nutzen der App erklären Sie sich mit diesen Bedingungen einverstanden. Wenn Sie diesen Bedingungen nicht zustimmen, nutzen Sie die App bitte nicht.

1. Lizenzgewährung und Geltungsbereich

Wir gewähren Ihnen eine widerrufliche, nicht exklusive, nicht übertragbare und begrenzte Lizenz zum Herunterladen, Installieren und Nutzen der App auf mobilen Geräten, die sich in Ihrem Besitz oder unter Ihrer Kontrolle befinden. Die Nutzung muss strikt in Übereinstimmung mit diesen Bedingungen sowie den Nutzungsregeln des Apple App Store und Google Play Store erfolgen.

2. Altersbeschränkungen und Berechtigung

Sie müssen mindestens 13 Jahre alt sein, um diese App nutzen zu dürfen. Wenn Sie zwischen 13 und 18 Jahre alt sind, müssen Sie diese Bedingungen gemeinsam mit Ihren Eltern oder einem Erziehungsberechtigten prüfen, um sicherzustellen, dass diese sie verstehen und ihnen zustimmen. Durch das Hochladen von Fotos in die App garantieren Sie, dass Sie diese Altersanforderungen erfüllen.

3. Benutzergenerierte Inhalte (UGC) & KI-Anprobe

  • Foto-Uploads: Die App ermöglicht es Ihnen, Fotos von sich selbst und Kleidungsstücken hochzuladen, um KI-Simulationen zu erstellen. Sie behalten alle Eigentumsrechte an Ihren Originalfotos.

  • Ihre Verantwortung: Sie sind allein für die von Ihnen hochgeladenen Fotos verantwortlich. Sie stimmen ausdrücklich zu, KEINE Fotos hochzuladen, die Nacktheit, explizite Inhalte, Gewalt, urheberrechtlich geschütztes Material ohne Erlaubnis oder Bilder enthalten, die die Persönlichkeitsrechte Dritter verletzen.

  • Missbrauch & Moderation: Wir behalten uns das Recht vor, Ihren Zugriff auf die App sofort zu beenden oder auszusetzen, wenn Sie gegen diese Inhaltsregeln verstoßen. Apple-Nutzer erkennen an, dass die App eine Null-Toleranz-Politik gegenüber anstößigen Inhalten verfolgt.

4. Abonnements, Credits und Zahlungen (RevenueCat)

Stylecam bietet Premium-Funktionen, Abonnementmodelle und zusätzliche Credit-Pakete an, die sicher über RevenueCat verwaltet und über die Abrechnungssysteme des Apple App Store / Google Play Store abgewickelt werden.

  • Abonnementverlängerung: Abonnements verlängern sich automatisch, sofern die automatische Verlängerung nicht mindestens 24 Stunden vor Ende des aktuellen Abrechnungszeitraums deaktiviert wird.

  • Credit-Pakete (Top-up): Gekaufte Credits sind nicht erstattungsfähig und nicht übertragbar. Credits werden bei jeder Durchführung des KI-Anprobevorgangs verbraucht.

  • Rückerstattungen: Alle Finanztransaktionen und Rückerstattungsanfragen werden ausschließlich von Apple oder Google abgewickelt, abhängig von der Plattform Ihres Geräts. Wir bearbeiten keine Rückerstattungen direkt.

5. Haftungsbeschränkung und Haftungsausschluss

  • „Wie besehen“-Basis: Die App und die KI-generierten Ergebnisse werden auf einer „Wie besehen“- und „Wie verfügbar“-Basis bereitgestellt. Wir garantieren nicht, dass die KI-Anprobesimulationen die Passform oder das Aussehen von Kleidung in der Realität perfekt widerspiegeln.

  • Keine technische Haftung: Wir haften nicht für Serverausfälle, Verzögerungen bei der API-Verarbeitung, die durch KI-Modelle von Drittanbietern (Vertex AI) verursacht werden, oder für Datenverlust.

6. Anwendbares Recht

Diese Bedingungen unterliegen den Gesetzen der Türkei und sind in Übereinstimmung mit diesen auszulegen. Alle Streitigkeiten, die sich aus der Nutzung der App ergeben, werden unter der Gerichtsbarkeit der Gerichte in Antalya, Türkei, beigelegt.

HİZMET ŞARTLARI VE SON KULLANICI LİSANS SÖZLEŞMESİ (EULA)

Yürürlük Tarihi: 2 Haziran 2026

Bu Son Kullanıcı Lisans Sözleşmesi (“EULA” veya “Şartlar”), Stylecam mobil uygulamasının (“Uygulama”) kullanımı için siz ile Global Sade Gıda Pazarlama Sanayi ve Ticaret Limited Şirketi (“Şirket”, “biz”, “bize” veya “bizim”) arasında yapılan yasal bir sözleşmedir. Uygulamayı indirerek, yükleyerek veya kullanarak bu Şartlarla bağlı olmayı kabul etmiş olursunuz. Bu Şartları kabul etmiyorsanız, Uygulamayı kullanmayın.

1. Lisans Verilmesi ve Kapsamı

Size, Uygulamayı sahip olduğunuz veya kontrol ettiğiniz mobil cihazlara indirmek, yüklemek ve kullanmak için; yalnızca bu Şartlar ve Apple App Store/Google Play Store tarafından belirlenen kullanım kuralları çerçevesinde geçerli olmak üzere, geri alınabilir, münhasır olmayan, devredilemez ve sınırlı bir lisans veriyoruz.

2. Yaş Sınırlamaları ve Uygunluk

Bu Uygulamayı kullanmak için en az 13 yaşında olmalısınız. 13 ile 18 yaş arasındaysanız, bu Şartları ebeveyniniz veya yasal vasiniz ile birlikte incelemeli ve onların da bu Şartları anlayıp kabul ettiklerinden emin olmalısınız. Uygulamaya herhangi bir fotoğraf yükleyerek, bu yaş gereksinimlerini karşıladığınızı beyan ve taahhüt edersiniz.

3. Kullanıcı Tarafından Oluşturulan İçerik (UGC) ve Yapay Zeka (AI) Deneme

  • Fotoğraf Yüklemeleri: Uygulama, yapay zeka simülasyonları oluşturmak için kendinize ait fotoğrafları ve kıyafetleri yüklemenize olanak tanır. Orijinal fotoğraflarınız üzerindeki tüm mülkiyet hakları size aittir.

  • Sorumluluğunuz: Yüklediğiniz fotoğraflardan yalnızca siz sorumlusunuz. Çıplaklık, müstehcen içerik, şiddet, izinsiz telif hakkıyla korunan materyaller veya üçüncü şahısların gizlilik haklarını ihlal eden görseller içeren fotoğrafları yüklememeyi kesin olarak kabul edersiniz.

  • Kötüye Kullanım ve Denetim: Bu içerik kurallarını ihlal etmeniz durumunda, Uygulamaya erişiminizi derhal sonlandırma veya askıya alma hakkımızı saklı tutarız. Apple kullanıcıları, Uygulamanın sakıncalı içeriklere karşı “sıfır tolerans” politikası uyguladığını kabul ederler.

4. Abonelikler, Krediler ve Ödemeler (RevenueCat)

Stylecam; RevenueCat aracılığıyla güvenli bir şekilde yönetilen ve Apple App Store / Google Play Store ödeme sistemleri üzerinden işlenen premium özellikler, abonelik modelleri ve kredi paketleri (top-up) sunar.

  • Abonelik Yenileme: Abonelikler, mevcut fatura döneminin bitiminden en az 24 saat önce otomatik yenileme kapatılmadığı sürece otomatik olarak yenilenir.

  • Kredi Paketleri: Satın alınan krediler iade edilemez ve devredilemez. Krediler, her yapay zeka deneme (Virtual Try-On) işlemi gerçekleştirildiğinde tüketilir.

  • İadeler: Tüm finansal işlemler ve iade talepleri, cihaz platformunuza bağlı olarak yalnızca Apple veya Google tarafından ele alınır. İadeleri doğrudan biz işlemeyiz.

5. Sorumluluk Sınırı ve Yasal Uyarılar

  • “Olduğu Gibi” Esası: Uygulama ve yapay zeka tarafından oluşturulan sonuçlar, “olduğu gibi” ve “mevcut olduğu şekilde” sağlanır. Yapay zeka deneme simülasyonlarının, kıyafetlerin gerçek hayattaki üzerinize oturuşunu veya görünümünü mükemmel bir şekilde yansıtacağını garanti etmiyoruz.

  • Teknik Sorumluluk: Sunucu kesintileri, üçüncü taraf yapay zeka modellerinden (Vertex AI) kaynaklanan API işleme gecikmeleri veya veri kaybı gibi durumlardan sorumlu değiliz.

6. Uygulanacak Hukuk

Bu Şartlar, Türkiye Cumhuriyeti yasalarına tabidir ve bu yasalara uygun olarak yorumlanacaktır. Uygulamanın kullanımından doğabilecek her türlü uyuşmazlık, Antalya, Türkiye mahkemelerinin yargı yetkisi altında çözümlenecektir.

Este Acuerdo de Licencia de Usuario Final (“EULA” o “Términos”) es un acuerdo legal entre usted y Global Sade Gıda Pazarlama Sanayi ve Ticaret Limited Şirketi (“Empresa”, “nosotros” o “nuestro”) para el uso de la aplicación móvil Stylecam (“App”). Al descargar, instalar o utilizar la App, usted acepta estar sujeto a estos Términos. Si no está de acuerdo, no utilice la App.

1. Concesión de licencia y alcance

Le otorgamos una licencia revocable, no exclusiva, intransferible y limitada para descargar, instalar y utilizar la App en dispositivos móviles de su propiedad o bajo su control, estrictamente de acuerdo con estos Términos y las reglas de uso establecidas por Apple App Store y Google Play Store.

2. Restricciones de edad y elegibilidad

Debe tener al menos 13 años de edad para usar esta App. Si tiene entre 13 y 18 años, debe revisar estos Términos con su padre, madre o tutor legal para asegurarse de que los comprendan y acepten. Al cargar fotos en la App, usted garantiza que cumple con estos requisitos de edad.

3. Contenido generado por el usuario (UGC) y prueba virtual con IA

  • Carga de fotos: La App le permite cargar fotos suyas y de prendas de vestir para generar simulaciones con IA. Usted conserva todos los derechos de propiedad sobre sus fotos originales.

  • Su responsabilidad: Usted es el único responsable de las fotos que carga. Acepta estrictamente NO cargar fotos que contengan desnudos, contenido explícito, violencia, material protegido por derechos de autor sin permiso, o imágenes que infrinjan los derechos de privacidad de terceros.

  • Abuso y moderación: Nos reservamos el derecho de terminar o suspender inmediatamente su acceso a la App si viola estas reglas de contenido. Los usuarios de Apple reconocen que la App aplica una política de tolerancia cero respecto al contenido objetable.

4. Suscripciones, créditos y pagos (RevenueCat)

Stylecam ofrece funciones premium, modelos de suscripción y paquetes de crédito (recargas) gestionados de forma segura a través de RevenueCat y procesados mediante los sistemas de facturación de Apple App Store / Google Play Store.

  • Renovación de suscripción: Las suscripciones se renuevan automáticamente a menos que la renovación automática se desactive al menos 24 horas antes del final del período de facturación actual.

  • Paquetes de crédito (Recargas): Los créditos comprados no son reembolsables ni transferibles. Los créditos se consumen cada vez que se ejecuta el proceso de prueba virtual (Virtual Try-On).

  • Reembolsos: Todas las transacciones financieras y solicitudes de reembolso son gestionadas exclusivamente por Apple o Google, según la plataforma de su dispositivo. Nosotros no procesamos reembolsos directamente.

5. Limitación de responsabilidad y descargos de responsabilidad

  • Base “tal cual”: La App y los resultados generados por IA se proporcionan “tal cual” y “según disponibilidad”. No garantizamos que las simulaciones de prueba virtual reflejen perfectamente el ajuste o la apariencia real de la ropa.

  • Sin responsabilidad técnica: No somos responsables de interrupciones del servidor, retrasos en el procesamiento de API causados por modelos de IA de terceros (Vertex AI) o pérdida de datos.

6. Ley aplicable

Estos Términos se regirán e interpretarán de acuerdo con las leyes de Turquía. Cualquier disputa que surja del uso de la App se resolverá bajo la jurisdicción de los tribunales de Antalya, Turquía.
